{"id":120,"date":"2019-06-20T17:10:41","date_gmt":"2019-06-20T17:10:41","guid":{"rendered":"https:\/\/ipaatentiti.com\/blog\/?p=120"},"modified":"2019-09-12T14:05:47","modified_gmt":"2019-09-12T14:05:47","slug":"new-indian-patent-amendment-rules-2016","status":"publish","type":"post","link":"https:\/\/ipaatentiti.com\/blog\/new-indian-patent-amendment-rules-2016\/","title":{"rendered":"New Indian Patent (Amendment) Rules 2016"},"content":{"rendered":"\n<p>The new Patent (Amendment) Rules, 2016 published by Ministry of Commerce and Industry, Government of India came into force with effect from May 16, 2016.<\/p>\n\n\n\n<p>Some of the salient features of the New Rules are:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Paperless work:<\/strong><\/li><\/ol>\n\n\n\n<p>The Patent Agents are required to file application only online and physical filing of patent application is dispensed with except for a few documents like Power of Attorney, Deed Assignment etc as in Public_Notice_18<sup>th<\/sup>&nbsp;May 2016 released by the Patent Office. (Click&nbsp;<a href=\"http:\/\/www.ipaatentiti.com\/wp-content\/uploads\/2016\/05\/publicNotice_18May2016.pdf\">here<\/a>&nbsp;for more details)<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Expedited Examination:<\/strong><\/li><\/ol>\n\n\n\n<p>A new rule 24C has been inserted to provide for expedited examination of applications.&nbsp; An applicant can file a request for expedited examination through Form 18A&nbsp; by paying the fee specified in the first schedule only by electronic transmission after due authentication within 48 months from the date of priority on any one of the following grounds:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>That India has been indicated as the competent ISA or IPEA in the corresponding International Application;<\/li><li>That applicant is a startup.<\/li><\/ul>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Video-conferencing of Hearings:<\/strong><\/li><\/ol>\n\n\n\n<p>With the insertion of sub-rule (6) in Rule 28, hearings may now be held through video conferencing or audio- visual communication.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>New Forms<\/strong><\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li>Form 18 A&nbsp;\u2013 Request for expedited examination of application for patent<\/li><li>Form 29&nbsp;\u2013 Request for withdrawal of patent application<\/li><li>Form 30&nbsp;\u2013 To be used when no other Form is prescribed<\/li><\/ul>\n\n\n\n<p>For further details of the New Rules, 2016&nbsp;<a href=\"http:\/\/www.ipaatentiti.com\/wp-content\/uploads\/2016\/05\/Patent_AmendmentRules_2016_16May2016.pdf\">click here<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The new Patent (Amendment) Rules, 2016 published by Ministry of Commerce and Industry, Government of India came into force with effect from May 16, 2016.
