{"id":238,"date":"2019-09-29T07:25:34","date_gmt":"2019-09-29T07:25:34","guid":{"rendered":"https:\/\/ipaatentiti.com\/blog\/?p=238"},"modified":"2019-09-29T07:42:42","modified_gmt":"2019-09-29T07:42:42","slug":"the-patents-amendment-rules-2019","status":"publish","type":"post","link":"https:\/\/ipaatentiti.com\/blog\/the-patents-amendment-rules-2019\/","title":{"rendered":"The Patents (Amendment) Rules, 2019"},"content":{"rendered":"\n<p>Government of India issued a\nNotification on September 17, 2019 making rules further to amend the Patents\nRules, 2003.<\/p>\n\n\n\n<p>The major amendments are as follows:<\/p>\n\n\n\n<p>There is good news for Patent\nApplicants who wish to get their patent granted soon, as the categories who can\nfile Request for Expedited Examination in Form 18A along with the prescribed\nfees has the new inclusion of that the<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>applicant is a small entity; or<\/li><li>applicant is a natural person or in the case of joint\napplicants, all the applicants are natural persons, then the applicant or at\nleast one of the applicants is a female; or <\/li><li>applicant is a department of the Government; or<\/li><li>applicant is an institution established by a\nCentral, Provincial or State Act, which is owned or controlled by the\nGovernment; or<\/li><li>applicant is a Government company; or<\/li><li>applicant is an institution wholly or\nsubstantially financed by the Government; or<\/li><li>applicant pertains to a sector which is notified\nby the Central Government on the basis of a request from the head of a\ndepartment of the Central Government; or<\/li><li>applicant is eligible under an arrangement for\nprocessing a patent application pursuant to an agreement between Indian Patent\nOffice and a foreign Patent Office.<\/li><li>apart from that the applicant is a startup or\nthat India has been indicated as the competent International Searching\nAuthority or elected as an International Preliminary Examining Authority in the\ncorresponding international application which already exists in the Patent Rules\nas amended in 2016.<\/li><\/ul>\n\n\n\n<p>The other one is there is no fee\nfor transmitting International application (for ePCT filing) &amp;
