The Draft Rules to amend The\nPatents Rules, 2003 was published on February 9, 2021 by the Ministry of\nCommerce and Industry, India where \u201celigible educational institution\u201d has been\nproposed to be added under Rule 2.<\/p>\n\n\n\n
Rule 2 ( ca) defines \u201celigible\neducational institution\u201das an institution established by a Central, Provincial\nor State Act, which is owned or controlled by the Government, and is wholly or\nsubstantially financed by the Government. <\/p>\n\n\n\n
Further explained as For the purpose of this clause, the term \u201csubstantially financed\u2018shall have the same meaning as in the Explanation to sub-section (1) of section 14 of the Comptroller and Auditor General\u2018s (Duties, Powers and Conditions of Service) Act, 1971(56 of 1971).<\/p>\n\n\n\n
The major proposal is that the eligible educational institutions shall pay the same fees as natural persons, start-ups and small entities. <\/p>\n\n\n\n
