{"id":45,"date":"2018-12-15T11:18:40","date_gmt":"2018-12-15T11:18:40","guid":{"rendered":"https:\/\/ipaatentiti.com\/blog\/?p=45"},"modified":"2019-09-02T08:36:59","modified_gmt":"2019-09-02T08:36:59","slug":"samsungs-design-patent-appeal-against-apple-denied","status":"publish","type":"post","link":"https:\/\/ipaatentiti.com\/blog\/samsungs-design-patent-appeal-against-apple-denied\/","title":{"rendered":"Samsung\u2019s Design Patent appeal against Apple Denied"},"content":{"rendered":"\n<p>In May, Samsung&nbsp;lost a previous appeal, ruling that it&nbsp;did infringe on some of Apple\u2019s design patents from the iPhone models.<\/p>\n\n\n\n<p>Samsung appealed a San Jose jury\u2019s August 2012 verdict that it violated Apple\u2019s patent or trademark rights in 23 products, such as the Galaxy S2 smartphone, as well as about $930 million in damages awarded to the iPhone maker<\/p>\n\n\n\n<p>During recent appeal, Samsung had urged the Federal Circuit to rehear the case with its full 12-judge roster, arguing that a three-judge panel erred earlier this year when it left intact a jury\u2019s verdict that the South Korean tech giant\u2019s smartphones and tablets infringed on Apple\u2019s design patents<\/p>\n\n\n\n<p>That part of the verdict \u2014 which has been pared from an original judgment of $1 billion \u2014 accounts for about $400 million of the $548 million in damages Samsung still must pay Apple from their first trial.&nbsp;The Washington, D.C.-based appeals court, which reviews all patent appeals, upheld the centerpiece of Apple\u2019s case against Samsung, which rested on claims that Samsung\u2019s smartphones and tablets violated Apple\u2019s patent rights on the iPhone.The products involved in this particular case are iPhone and Samsung Galaxy\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In May, Samsung&nbsp;lost a previous appeal, ruling that it&nbsp;did infringe on some of Apple\u2019s design patents from the iPhone models.
