The term ‘design’ has been defined to mean the features of shape, configuration, pattern, ornament or composition of lines or colours applied to any article. The article can be either in two-dimensional or three dimensional or both.

The Design Act prohibits the registration of designs which are not new or original, designs which are already disclosed in the public domain and the designs which are not significantly distinguishable from known designs or combination of known designs.

The duration of the registration of a design is initially ten years from the date of registration but can be extended by further period of five years.

A Design right holder can license or sell his design as legal property for a consideration or royalty.

Any person claiming to be the proprietor of any new or original design not previously published in any country and which is not contrary to public order or morality can make an application for the registration of designs.
