The Prime Minister of India Shri. Narendra Modi in his Independence Day speech gave a strong message of “Start-up India; Stand-up India” to Indian citizens. As to achieve this goal, all the Ministries of the country are in the process of developing a frame work for a start-up business. The Ministry of Commerce and Industry is about to release its final frame work which has included the consultancy on intellectual property rights as one of the components in its structure for start-ups.
As per Nasscom’s ‘Startup Report 2014’, India has the world’s third largest and the fastest-growing start-up ecosystem. The country has 3,100 start-ups and nearly 800 get added every year. The number of start-ups in India is likely to grow to 11,500 by 2020, according to the report.
While launching the start- up business, several factors are in the inclusive list of an entrepreneur to make the business success but least importance is given to the protection of their intellectual property. The reasons that can be attributed may be the lack of awareness of the importance and implications of intellectual property in their business and secondly, the quite expensive factor of intellectual property protection.
The different facets of IPR which are pertinent to start-ups are patent, trademark, copyrights and designs. The protection of your innovation play a dual role of safe-guarding your new product or new brand and at the same time it also takes care that you are not infringing on others innovation which has serious repercussions.
