The Patent Application has to be filed at the appropriate patent office. Application can be made by the true and first inventor of the invention or by an assignee of the person or by the legal representative of any deceased person. An application for a patent for an invention can be filed by any of the above persons either alone or jointly with any other person.

The Patent application can be for Utility patents or Design Patents or Plant patents as followed in USA or it may be for Ordinary Patent or Patent of Addition or Divisional Patent as in India. The Patent application may be a provisional or non-provisional (complete) application.

The patent application, notices or any other documents to be filed at the Patent Office can be filed by hand or sent through post or courier service or by electronic submission. The patent application has to be filed with the relevant fees and forms for processing of the application.
