Decathlon, a French-based company, one of the largest sporting goods retailer in the world with 1647 stores in nearly 1000 cities in 57 countries and regions (Jan 2020) including many stores spread across states in India has filed a trademark infringement suit against NCR-based Pentathlon Sports.
Decathlon alleges that the Pentathlon infringes the registered trademark of Decathlon, visually and phonetically and further alleges that Pentathlon has copied their famous tagline displayed below the registered trademark.
Pentathlon responds that the font and color scheme used in their trademark is not similar to Decathlon and further responds that Pentathlon Sports is a multi brand sporting goods retail and e-commerce company with internationally recognized brands including Yonex, Wilson, Cosco, Montra, Roadeo, Coleman, Nike, Adidas, SS and Headly.
Pentathlon added that they have been working on years to bring different sports brands under one roof while Decathlon mostly sells its own brands.
The case is currently pending in Ghaziabad District Court (Case number: 35/2019) and the next hearing is scheduled in the court of Sri Abhishek Kumar Srivastava (A.D.J. Court No.6 ) on Apr. 07, 2021, will track the further development in the suit.
